Jihadists in Prison in Afghanistan Can Now Challenge Detention in U.S. Courts
Last year before the election when the Supreme Court ruled that foreign terrorists in Guantanamo Bay have constitutional rights, Barack Obama supported it. President Obama opposes giving constitutional rights to foreign terrorists in Afghanistan held in Bagram. Why would the constitution apply to foreigners in Cuba but not to foreigners in Afghanistan? I don't know. But for all those concerned about the constitutional rights of terrorists needn't fear. A federal judge has ruled that foreign terrorists can challenge their detention in U.S. courts. Judge Bates ruled that three prisoners can challenge their detention in U.S. courts because they claim that they were captured outside of Afghanistan. So now a detainee just has to claim that he was captured outside of Afghanistan and he now has constitutional rights. You know that this judge is insane if even President Obama thinks it's a bad idea.
